AR120 – sponsored by Assemblyman Herb Conaway (Burlington) and Assemblywoman Shanique Speight (Essex and Hudson), Urges Amendment of Streamlined Sales and Use Tax Agreement to create definition for oral health care products. VIEW

Identical Legislation:

SR81, sponsored by Senator Nellie Pou (Bergen and Passaic). VIEW.

NJDA Statement:  The NJDA strongly supports this effort to modify the Streamlined Sales and Use Tax Agreement, with the end goal of eliminating New Jersey Sales and Use Tax on personal consumer hygiene products such as toothbrushes, toothpaste, mouthwash, dental floss, and more. These items offer critical protection for New Jersey residents against oral health issues that can lead to serious overall health consequences. The additional tax barrier on these items is prohibitive, and often forces New Jersey families to make an economic determination when deciding whether to purchase a toothbrush, or another essential household product. Eliminating the sales tax barrier will make it easier for New Jerseyans to choose these products and will send the message that New Jersey sees oral healthcare as essential.

Currently, New Jersey is a member of the Streamlined Sales and Use Tax Agreement, which precludes a simple elimination of tax on oral health care products. This agreement must be modified to move forward. This resolution is a positive step towards the eventual elimination of sales tax on these critical items and raises awareness about the importance of oral health for our state.
